COURSE INFORMATION (2013 ENTRY)

Students who have successfully completed the Graduate Diploma in Law (GDL) within the past five years are eligible to convert their Diploma into an LLB (Hons) degree by either part-time or distance learning (open learning) study. This requires the study of either two additional legal subjects or the submission of a project of 10,000 - 15,000 words on a legal subject chosen from the following list:

Company Law
Company Law considers a wide range of topics relating to both private and public companies. These include: how companies are formed; how they are managed and controlled; how they are financed; and what happens if they become insolvent. Particular emphasis is given to the legal rights and duties of directors and shareholders.

Employment Law
The programme entails a study of individual employment law i.e. the contractual and statutory regulation of the relationship between employer and employee. Consideration will be given to: Sources and institutions of employment law; Worker status; Contents of the contract of employment: express terms, implied terms, standard common law duties; Formalities: section1 statement; Wages, including equal pay, minimum wage; Unlawful discrimination; Breach of contract, wrongful dismissal and remedies; Unfair dismissal and remedies; Redundancy; and Transfers of undertakings.

Evidence
The evidence options on the LLB part-time and Open Learning programmes are concerned with the major principles of criminal and civil evidence. Specifically, the areas of the Law of Evidence which are covered comprise: the burden and standard of proof; the rule against hearsay and its major criminal and civil exceptions; confessions; silence; unlawfully obtained evidence; the character of the accused (including similar fact evidence); the examination of witnesses, the competence and compellability of witnesses; supporting evidence; identification evidence; lies told by the accused; opinion evidence; privilege; public interest immunity and estoppel by record. Assessment is by a three hour open book examination at the end of the programme.

Medical Law
This module looks at the legal consequences of medical misadventure, for example, suing in a court of law. Additionally, the ethical and legal rules surrounding the more controversial developments that have taken place in the field of medicine are explored. These include cloning, surrogacy, euthanasia and other topical issues.
