Terms and Conditions for NU-Cycle 2023 Prize Draw
1. THE PROMOTER
1.1 The promoter is Northumbria University at Newcastle of Northumbria University Sutherland Building College Street Newcastle upon Tyne NE1 8ST. Herein referred to as ‘The promoter’.
2. THE COMPETITION
2.1 The title of the competition is NU-Cycle 2023 Prize Draw.
2.2 Entrants must have signed up to take part in the NU-Cycle, fundraised donations on the dedicated JustGiving page and be aged 18 years or over. Anyone connected with the administration of the Promotion is not eligible to participate
3. HOW TO ENTER
3.1 The competition will run from 9am on 20th September 2023 (the “Opening Date”) to 5pm on 31st October 2023 (the “Closing Date”) inclusive.
3.2 All competition entries must be received by the Promoter [at the address set out at 1] by no later than 5pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
3.3 To enter the competition:
(I) The Promotion is free to enter and no purchase is necessary.To enter the Promotion, you must sign up to take part in NU-Cycle 2023 via the online form and fundraised via the JustGiving page. No minimum amount of donations raised is necessary. There can be only one entry per person. Entries on behalf of another person will not be accepted. If a team is drawn as the winner from the prize draw, there will then be a further draw in which team member names will be submitted and one drawn to win.
3.4 The Promoter will not accept:
(a) responsibility for competition entries that are incomplete, lost, mislaid, damaged, corrupted or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or(b) proof of posting or transmission as proof of receipt of entry to the competition.
3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
3.6 Please email alumni@northumbria.ac.uk for a copy of these competition terms and conditions.
3.7 The winning competition entry will be chosen at random via a computer process, this will be supervised by an independent person. This selection process will take place within 30 days of the competition closure date.
3.8 The Promoter will send the full details of the computer programme used and the details of the independent supervisor to anyone who writes within one month after the Closing Date of the competition requesting details of the judge and who encloses:
a) self-addressed envelope to the address set out to:

4. ELIGIBILITY
4.1 The competition is only open to all current Northumbria University Students and staff aged 18 years or over, except:
(a) employees of agents or suppliers of the Promoter, who are professionally connected with the competition or its administration; or
(b) members of the immediate families or households of the above.
4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
4.3 The Promoter will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with;
(d) incomplete
4.4 Entries on behalf of another person will not be accepted and joint submissions are not allowed.
4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
5. THE PRIZE
5.1 The prize is one year’s membership to Northumbria University’s Sport Central gym and there is ONE available to be won.
5.2 Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a cash alternative to the value of the prize.
5.3 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
5.4 The prize is not negotiable or transferable.
5.5 In order to claim the prize you must respond within 120 hours of being notified, if not you will forfeit your prize and Northumbria University reserves the right to choose another winner.
6. WINNERS
6.1 The decision of the computer process overseen by an independent supervisor is final and no correspondence or discussion will be entered into.
6.2 The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the email address or postal address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.
6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will:
(a) send the surname and the country of residence of each winner to anyone who emails [Northumbria University Alumni & Philanthropy Office] at [alumni@northumbria.ac.uk] within thirty (30) days after the closing date stated in paragraph 3 above.
(b) send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails alumni@northumbria.ac.uk or writes to the address set out in Condition 1 (enclosing a self-addressed envelope) within one month after the Closing Date of the competition.In such circumstances, Northumbria University must still supply the information to the Advertising Standards Authority upon request.
6.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter, nucareers@northumbria.ac.uk. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
7. CLAIMING THE PRIZE
7.1 Please allow 30 days for delivery of the prize. If you are the winner of the prize, you will have 120 hours from the Announcement Date to claim the prize. If you do not claim the prize by this date, your claim will become invalid.
7.2 The prize may not be claimed by a third party on your behalf.
7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within 120 hours of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.
8. LIMITATION OF LIABILITY
8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. The extent of the promoters liability to you, whether in contract, tort or otherwise is capped at the value of £50.00 GBP. will be Your statutory rights are not affected.
9. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
9.1 All competition entries and any accompanying material submitted to the Promoter will not become the property of the Promoter on receipt of entry. The Promoter does not claim any rights of ownership in your competition entry.
9.2 You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition.
10. DATA PROTECTION AND PUBLICITY
10.1 The Promoter will only process your personal information as set out in the https://www.northumbria.ac.uk/about-us/leadership-governance/vice-chancellors-office/legal-services-team/gdpr/. See also Condition 6.3 and Condition 6.4, with regard to the announcement of winners.
10.2 If the Promotion is publicised on Facebook, Twitter, Snap Chat, Instagram or any other social media platforms, the Promotion is in no way sponsored, endorsed or administered by, or associated with, any of these social media platforms. By participating in the Promotion, entrants agree to release and hold harmless each such social media platform from any and all liabilities incurred directly or indirectly in consequence of, or arising from, the Promotion or participation in it.
11. GENERAL
11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
11.2 Any visitor who posts a comment that contains any negative or offensive wording will automatically be removed from the competition and declared ineligible to participate.
11.3 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
11.4 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
